3. HEALTH GUARANTEE AT THE TIME OF PURCHASE

The breeder guarantees that the dog will be in good health at the time of purchase and will have received all necessary vaccinations and dewormers. This guarantee is valid for a period of 7 days following the transfer of ownership.

During this seven-day period, should the dog present signs of disease which may have originated from the breeder's kennel, the dog may be returned to the breeder (at a time specified by the breeder) provided the buyer has notified the breeder within the 7-day period and has safely returned the dog without harm to the animal's health.

Accordingly, any expenses incurred for emergency medical care within the 7-day period will be refunded by the breeder (50% of the medical expenses to a maximum of 100$).

The breeder will not be, in any way, responsible for injuries, illnesses or the death of the dog if the cause occurs after the buyer has taken possession of the dog.

4. GUARANTEE RELATING TO HEREDITARY DISEASES

The breeder guarantees the health of the dog up to 60 months of age for any hereditary condition that cannot be adequately detected at the time of purchase.

The breeder also guarantees that the dog will be free of hip and/or elbow dysplasia provided that the dog is x-rayed by a veterinarian specialized in this manner between 24 and 58 months of age and that the buyer informs the breeder and asks that the guarantees stipulated in clause 7 be applied before the dog reaches 60 months of age. If the dog is too fat or obese, the guarantee will be annulled.

5. GUARANTEE OF TEMPERAMENT

The breeder guarantees that dog is of sound termperament typical of the breed. The breeder is not responsible for a dog that may display shyness or extreme aggressiveness unless a similar defect is shared by several pups of the same litter. Otherwise, it will be assumed that the problem is the result of unsuitable handling practices or training on the buyer's behalf.

6. EXHIBITION GUARANTEE

The buyer understands that in case of exhibition, the breeder cannot guarantee that the dog sold will be or become of exhibition quality and accepts that limitation. However, the breeder guarantees that the dog will not be rendered unsuitable for competition as a result of a hereditary defect up to 24 months of age.

7. APPLICATION THE GUARANTEES UNDER CLAUSES 3,4,5 6

It is understood that any dog that has been euthanized (for whatever reason) will not be replaced or refunded unless the procedure has been authorized beforehand by the breeder or required for emergency humanitarian reasons.

Moreover, the breeder may have the dog examined at his expense for the purpose of obtaining a second opinion or for performing the necessary treatments (Daubigny Hamel bd. Quebec, Medical Veterinary School in Ste-Hyacinthe) and thus, at the buyer expenses.

For the application of guarantees under clauses 3,4,5 and 6, the breeder will compensate the buyer only once, by one of the following two methods (determined by the buyer). It is understood that the breeder will not assume any other responsibility than the actual cost (regardless of the reason).

A) Return of the dog to the breeder.

The buyer may euthanized (following the breeder autorization) the dog showing clinical signs (E.g.: limping) and return the registration certificate to the breeder. The dog will than be replaced free of-charge and under the same conditions by another dog of comparable quality if available in a 12 month-period following the death of the dog.

If no dog is available or selected for this purposes in the 12 months period or if the breeder decides so before the 12 months deadline expires, the latter will simply refund the total price paid for the dog.

B) Dog kept by the buyer.

If the quality of life of the dog is affected to the extent of requiring particular veterinary treatments and if the buyer chooses to keep the dog, the breeder will refund veterinay bills up to 50% of the total price paid for the dog.

8. NON-BREEDING AGREEMENT

In order to maintain a high standard of quality of Bernese Mountain dogs for the purposes of breeding and thus preserve the quality of the breed, it is understood that upon purchase of the dog, the buyer will sign a non-breeding agreement prepared by the Canadian Kennel Club.

In case of live birth resulting from such mating of this dog during the non-breeding agreement period, the buyer will have all resulting puppies euthanized at birth. If such is the case, the breeder may claim damages from the buyer at a cost of one thousand dollars per unauthorized pups.

It is therefore understood that the dog will not under any circumstances be used for reproduction.

Should this be the case, the breeder may claim damages from the buyer at a cost of five thousand dollars per unauthorized litter. Failure to respect this condition will result in the ownership of the dog reverting to the breeder without refund.

DOCUMENTATION PROVIDED BY THE BREEDER

When the dog is purchased by the buyer, the breeder will provide photocopies of the registration certificates for the stud and the bitch as well as health record for the puppy describing all vaccinations and dewormers that have been administered to the dog.

The breeder will give the buyer the registration certificate upon proof that the animal has been spayed or neutered (between five and eight months of age). The breeder will provide this registration certificate before the pup reach the age of twelve months.

BUYER'S RESPONSIBILITIES AND OBLIGATIONS

The buyer accepts full responsibility for the dog's upkeep from the time of purchase.

It also agrees to take all necessary and reasonable measures to prevent the dog from running away or being stolen, to feed him correctly and without excess, to provide him with fresh water at all times, to care for its fur, claws and ears and to give him regular exercise necessary for its well-being.

The owner will also ensure that the dog's health record is kept up-to-date and that the dog receives the necessary veterinary care including an annual examination.

It is strictly prohibited to keep the dog inside a crate for 8 to 10 hours during the day, and 8 to 10 hours during the night, or to tie him to a post with a chain. The dog will live in the house has a full family member.

The buyer understands and accepts that these responsibilities are part of the sales contract and that failure to respect these conditions will entitle the breeder to retrieve the dog without notice or refund.

The buyer agree to inform the buyer within 30 days, of any address or telephone number changes.

DISPOSAL OF THE DOG BY THE BUYER

It is understood that the dog will not be resold, given away, rented or exchanged to a petshop, a multi-branch store, puppy broker, puppy mill, commercial breeding establishment, lottery, draw, auction, foundation or charity.

If the buyer decides to re-home the dog, it must be returned to the breeder without refund.

If the dog is sold, given away, rented or exchanged without written consent from the breeder, the buyer agrees to pay damages to the breeder equal to or greater than of the initial sales price.
